Liability For Chicago Car Accidents
Speeding remains a major cause of car accidents across Chicago. According to the Chicago Department of Transportation, “70% of Chicago traffic deaths involved drivers traveling at high speeds. Over half of pedestrians killed in the city are hit by an SUV or larger vehicle.” Drivers should take a number of measures in order to avoid hitting other vehicles.
- Drivers should check their blind spots before making turns.
- Drivers should use their horns to alert other drivers of their presence.
- Drivers should slow down during periods of inclement weather.
All drivers must take reasonable steps in order to avoid colliding with other vehicles. Pursuant to (625 ILCS 5/11-904), “After slowing or stopping, the driver shall yield the right-of-way to any vehicle in the intersection or approaching on another roadway so closely as to constitute an immediate hazard during the time such driver is moving across or within the intersection.” If a driver fails to slow down to avoid a collision, this could form the basis of a negligence claim. It is important that certain steps are taken after any car accident.
- Eyewitnesses should be interviewed.
- Medical records should be preserved.
- Surveillance footage should be sought.
- An experienced personal injury attorney should be contacted.
Drivers of buses, vans, and other commercial vehicles are considered common carriers under Illinois law. They are held to a particularly high standard in terms of safety. They must operate their vehicles with a great deal of vigilance in order to avoid collisions. Any person injured in a collision with a van may have legal recourse through a civil claim.
