Liability In Joliet Pedestrian Accidents

Pedestrians are uniquely vulnerable in car accidents. They lack the protection of enclosed vehicles and are more likely to be overlooked. According to one report from the Centers for Disease Control, “an estimated 137,000 pedestrians were treated in emergency departments for nonfatal crash-related injuries in 2017. Per trip, pedestrians are 1.5 times more likely than passenger vehicle occupants to be killed in a car crash.” There are a number of factors that could potentially influence the likelihood of a pedestrian accident including:

  • Speeding
  • Drunk driving
  • Inclement weather
  • Driver distraction

Parking lots can be particularly dangerous for pedestrians. They are often poorly lit and cars can come from any direction. Pursuant to Illinois Vehicle Code (625 ILCS 5/11-1003.1), all drivers must exercise due care in order to avoid hitting pedestrians. They must be particularly cautious around children or any obviously confused or intoxicated person. Many pedestrian accidents in parking lots are due to elderly drivers that experience pedal confusion. Pedal confusion occurs when a driver thinks they’re hitting the brakes, but they inadvertently hit the accelerator.

Depending on the facts of any case, the owner of a parking lot could potentially be held at fault for a collision. If the owner of a parking lot fails to adequately maintain their property and that property was in a dangerous condition, this could form the basis of a negligence claim. The owner of a parking lot must remedy any potentially dangerous condition in a parking lot that could contribute to an accident. There are a number of ways that a parking lot could potentially be in a dangerous condition.

  • A  parking lot may lack a designated walkway for handicapped people.
  • A parking lot may have inadequate signals, signs or markings.
  • A parking lot may have been negligently maintained so that snow or ice accumulated.
  • A parking lot may have uneven surfaces or potholes.

The family of any victim that died in a parking lot accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. It is extremely important that evidence is properly preserved after an accident.  Evidence is what will ultimately be used to determine liability for a collision. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
