Liability for Cook County Dump Truck Accidents

Dump trucks can be incredibly dangerous to pedestrians, motorcyclists, and everyone in a passenger vehicle. According to TDI, “The Bureau of Labor Statistics reports that 536 dump truck-related deaths and 7,270 serious injuries occurred in the U.S between 2015 and 2020. Many of these resulted from tip-overs caused by unbalanced loads.” Dump truck companies should take several actions to help prevent collisions.

  • Maintenance: Dump truck companies should ensure that their vehicles are routinely inspected and well maintained. Any type of vehicle system failure can cause a dump truck to become unstable and substantially increase the odds of a crash.
  • Training: Dump trucks can be incredibly difficult to operate in the best of circumstances. Truck companies must ensure that their drivers are intimately familiar with how their vehicle operates.
  • Compliance: Truck companies should ensure that they are compliant with all hours of service regulations. Having dump truck drivers work too many hours in a day or week could potentially leave them to become dangerously fatigued.

Dump truck drivers must operate with an abundance of caution to avoid colliding with any vehicle in the roadway. Among other things, they must maintain a safe distance from the vehicle ahead of them. Pursuant to 625 ILCS 5/11-710, the driver of a motor vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of such vehicles and the prevailing traffic conditions on the roadway. If a truck driver fails to slow down to avoid a collision with a motorcyclist, they could be held at fault through a civil claim.

Employers in Illinois are considered vicariously liable for the wrongful actions of their employees. In short, employers are responsible when their workers make mistakes. This is also true if a truck driver was employed by some company when they were involved in a collision. For vicarious liability to apply, the truck driver must’ve been working within the course and scope of their job duties. This may include situations where they were transporting goods from one location to another. Gathering evidence is essential after any truck accident.

  • Surveillance Footage: Many collisions are captured by traffic cameras. Even if an accident was not captured by traffic cameras, it is common for businesses to have surveillance cameras that may have captured the accident.
  • Accident Scene: The scene of any accident can reveal a great deal about what happened. For example, a lack of skid marks in the roadway can help demonstrate that a truck driver didn’t even attempt to brake prior to a collision.
  • Eyewitnesses: Another important resource is the testimony of eyewitnesses. They can help indicate what happened prior to a collision.

Truck accidents are often highly preventable. They tend to be the results of truck drivers that are failing to observe traffic regulations. This can include situations where these drivers make dangerous lane changes or travel too fast for the prevailing conditions. Unlike smaller vehicles, a commercial truck traveling at freeway speeds can take the length of two football fields to come to a safe stop. Sadly, these drivers often do everything in their power to deny responsibility when they’re involved in a serious crash. This is why it can be so important to have any truck accident thoroughly investigated by an outside party.
