Cook County officials are saying that the accident took place around noon on Saturday near the entrance of Peteās Fresh Market. Angel GonzalezĀ was on an electric scooter when he was hit by a bronze crossover making a U-turn.
The driver reportedly got out of his vehicle to help the scooter rider after he became stuck under the vehicle. However, that same driver got back in his vehicle and took off without providing any identification.

Liability for Gage Park Hit-and-Run Car Accidents
Illinois law requires that drivers use reasonable care to avoid colliding with pedestrians and those riding scooters. This necessitates that they maintain a reasonable speed at all times given the prevailing conditions and maintain a proper lookout. Separately, 625 ILCS 5/11-403Ā requires that drivers remain at the scene of any injury collision and exchange license and insurance information with the affected parties. There are many different ways that any driver may have acted negligently prior to a pedestrian collision.
- Speed: A driver may have been traveling at a speed that would be unsafe given the road conditions.
- Intoxication: A driver may have been intoxicated due to their use of alcohol or drugs. Even prescription medications can substantially impair a driver’s judgment.
- Fatigue: A driver may have been operating a vehicle while they were extremely fatigued.
- Distraction: Driver distraction remains one of the leading causes of pedestrian collisions.
When a driver fails to slow down to avoid colliding with any pedestrian in the roadway, this could form the basis of a negligence claim. Even if a pedestrian is outside of a marked crosswalk, this does not remove a driver’s duty of care to slow down and avoid the collision. Drivers that flee the scene of any injury collision could face criminal charges in addition to being held civilly liable for the crash. Any person involved in a pedestrian collision is required by law to remain at the scene and exchange insurance information with those affected.
Preserving Evidence and Seeking Accountability After Electric Scooter Crashes
Thousands of people are seriously injured or killed every year in hit-and-run crashes. Increasingly, many of these collisions have involved scooters and other micromobility devices. According to the U.S. Consumer Product Safety Commission, there were an estimated 380,000 emergency department visits treated nationwide for accidents involving electric scooters. It is important that evidence is properly preserved after any one of these crashes.
- All of the surveillance footage that may have captured the collision should be collected and preserved.
- Fragments of any vehicle that fled the scene of the crash should be sought. These can help identify the driver involved at a later date.
- Witnesses that may have seen what happened should also be interviewed as early as possible.
- Medical records related to treatments involving the crash can also help paint a clear picture of what went wrong.
Hit-and-run collisions are typically highly preventable. They tend to involve situations where drivers are intoxicated or not properly scanning the road ahead of them. Unfortunately, insurance companies are not likely to accept responsibility when one of their drivers causes a serious injury crash. This is why it is so important that the victims carefully consider their options with a team experienced in negligence claims.
