Liability for DeKalb County Car Accidents

Drivers in Illinois have a duty of care to all of the other people that they share the road with. This necessitates that they maintain a proper lookout at all times and obey all speed regulations. According to Illinois Vehicle Code 625 ILCS 5/11-601, “No vehicle may be driven upon any highway of this State at a speed which is greater than is reasonable and proper with regard to traffic conditions and the use of the highway, or endangers the safety of any person or property.” Rear-end collisions are among the most common accidents people are involved in and are typically highly preventable when the right precautions are taken.

  • Follow Distance: Drivers must maintain adequate separation with any car ahead of them. This distance should be increased during periods of inclement weather or heavy traffic.
  • Scanning: Drivers should continuously scan the road ahead of them for potential hazards.
  • Maintenance: Drivers should ensure that their vehicles are periodically inspected and well maintained.
  • Speed: Drivers must reduce their speed as necessary, given the specific conditions that they encounter.

Courts across Illinois will nearly always find drivers that rear-end vehicles in their own lane of traffic liable. There is a presumption of negligence on the part of any driver that hits another vehicle ahead of them. Even if a vehicle were completely stopped in the roadway, drivers should be able to react in time and slow down accordingly. When evaluating liability for any collision, it matters if a reasonably prudent person would’ve been able to avoid the crash if they were in the same situation.

These can potentially manifest through anxiety and posttraumatic stress disorder. It is important for accident victims to understand that all of their injuries can be taken into consideration by the court system. Victims are able to seek some measure of accountability and justice through a personal injury claim. Damages in a simple claim can help cover lost wages, medical bills, and pain and suffering.
