Arcadia Care Danville Facing Violations After Resident Died

DANVILLE, ILLINOIS (February 28, 2024) – Several central Illinois nursing homes are facing violations under the Nursing Home Care Act including one incident where a resident died.

Central Illinois officials are saying that several nursing homes are facing various fines for the violations. A number of nursing homes were cited including Arcadia Care Jacksonville, Fair Haven Senior Living in Decatur, Illini Heritage Rehab & Healthcare in Champaign, and Manor Court of Clinton.

Arcadia Care Danville faced the most serious violation after one resident died. Officials claim that the nursing home failed to address the physical needs of the resident.

They said the nursing home overlooked crucial bloodwork for the patient. A report of the incident states that this oversight ultimately led the patient to go into respiratory distress before dying.

A full investigation into all of the violations remains ongoing at this time.

Liability For Central Illinois Nursing Home Violations

Abuse and neglect within nursing homes are sadly very common. According to Cureus, “Elder abuse can present in many forms, including physical abuse, psychological/emotional abuse, sexual abuse, financial abuse, and neglect. Many studies estimate that about 10% of all people over the age of 65 experience some form of abuse. These rates are often higher in long-term care facilities such as nursing homes, despite government regulations aimed toward addressing this issue.” There are a number of measures that nursing homes should take in order to prevent residents from being abused.

  • Staff Training: All staff at a nursing home should be trained to recognize the signs of neglect. They should also be taught proper care techniques.
  • Background Checks: Nursing homes should ensure that all employees pass thorough background checks.
  • Staff Levels: Nursing homes should ensure that they are adequately staffed so that residents can get the care that they need.
  • Zero Tolerance Policies: Nursing homes should have a zero tolerance policy for the abuse or neglect of residents.

There are a number of federal and state laws that protect people in nursing homes. According to the Illinois Nursing Home Care Act, a nursing home resident has the right to be free from abuse or neglect. The owner of a nursing home could be liable if their employee abuses or neglects a resident. When nursing home employees fail to adequately care for patients, their employer could be vicariously liable. A nursing home resident could be neglected or mistreated in a variety of different ways.

  • Many nursing home residents have very limited mobility. They will typically need to be moved periodically in order to avoid developing bedsores (pressure ulcers). Bedsores can lead to very serious and life-threatening infections.
  • Nursing home residents are also much more prone to being injured in falls. To that end, a resident may need help getting in and out of bed. A large portion of the injuries at nursing homes involve falls.
  • Nursing home residents are also regular targets of physical abuse. This could be instances where they are punched, kicked, slapped, or hit by employees.
  • It is also common for nursing homes to fail to adequately treat the medical needs of residents. For example, staff may have failed to give residents their medications. Or they may have overlooked a situation where a resident needed emergency care.

One of the major problems with many nursing homes is that they are not adequately staffed. Nursing homes can be very challenging places to work. They have some of the highest turnover rates of all professions. When a nursing home is understaffed, this can easily lead to situations where patients are not being adequately looked after. It is important for victims of nursing home abuse and neglect to understand that they do have rights.
