Liability for Kane County Semi-Truck Accidents

Pedestrians are uniquely vulnerable to the hazards posed by semi-trucks. According to National Public Radio, “Vehicles with higher front ends and blunt profiles are 45% more likely to cause fatalities in crashes with pedestrians than smaller cars and trucks, according to new research published Tuesday by the Insurance Institute for Highway Safety.” Truck drivers should take numerous measures in order to avoid hitting pedestrians.

  • Semi-truck drivers should check their blind spots before making turns.
  • Semi-truck drivers should take periodic brakes as mandated by law.
  • Semi-truck drivers should slow down in areas with heavy pedestrian traffic.
  • Semi-truck drivers should abstain from alcohol and other intoxicating substances.

Semi-truck drivers are required to get a commercial driver’s license and are held to a high standard in terms of safety. Truck drivers must follow all rules and regulations laid out in Title 49 of the Code of Federal Regulations. They must also be particularly cautious to avoid hitting pedestrians. If a semi-truck driver fails to slow down to avoid hitting a pedestrian in the roadway, this could form the basis of a negligence claim.

Liability for any semi-truck accident could extend beyond any driver. The company that a semi-truck driver worked for could also be held at fault for a collision. Generally speaking, companies are vicariously liable for the wrongful actions of their employees working within their job duties. However, some truck companies do hire their drivers as “independent contractors.” Several steps should be taken after any semi-truck accident.

  • The employment status of the semi-truck driver involved should be understood.
  • Eyewitnesses should be interviewed.
  • The event data recorder (EDR) of the truck involved should be reviewed.
  • Medical records related to any injuries should be preserved.

Semi-truck accidents often leave victims with life-altering injuries. These can impair a person’s ability to work and live a normal life. Sadly, though, truck companies and their insurance providers will often do everything in their power to deny responsibility if someone is injured by one of their drivers. This is why it is so important for victims of semi-truck accidents to seek the guidance of an experienced personal injury attorney.
