Liability For Glencoe Amazon Truck Accidents

As Amazon has continued to grow over the years so to have the number of collisions involving Amazon delivery vehicles. According to the New York Times, “Amazon’s promise of speedy delivery has come at a price, one largely hidden from public view. An investigation by ProPublica identified more than 60 accidents since June 2015 involving Amazon delivery contractors that resulted in serious injuries, including 10 deaths.” There are a number of factors that could contribute to an accident with an Amazon delivery vehicle.

  • Delivery drivers may make dangerous left turns.
  • Delivery drivers may fail to scan the road ahead of them for hazards.
  • Delivery drivers may follow cyclists too closely.

All drivers have a legal obligation to exercise due care in order to avoid hitting bicyclists. According to Illinois Vehicle Code 625 ILCS 5/11-601, no person shall operate a motor vehicle at a speed greater than would be reasonable or prudent given the prevailing conditions of the roadway. If a driver fails to slow down to avoid hitting a bicyclist, this could form the basis of a negligence claim. In particular, drivers must maintain at least three feet of separation from cyclists at all times.

Depending on the facts of any case, the company that a delivery driver worked for could be liable for a collision. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. However, Amazon has consistently tried to evade liability for collisions by hiring drivers as “independent contractors.” Victims of car accidents tend to suffer very serious injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

Being involved in a serious car accident is often one of the most difficult things that most people will ever go through. Victims are often left with high medical bills and may need to take extensive periods of time off of work. Any person that is injured in a car accident with a delivery vehicle may be able to seek some measure of justice through a civil claim.
