Liability For Mt Carmel Car Accidents

Bicyclists are uniquely vulnerable to the hazards posed by motor vehicles. They are much more likely to be overlooked and lack the protection of enclosed vehicles. According to the Centers for Disease Control, “Bicycle trips make up only 1% of all trips in the United States. However, bicyclists account for over 2% of people who die in a crash involving a motor vehicle on our nation’s roads.” There are a number of measures that drivers should take in order to avoid hitting bicyclists.

  • Drivers should slow down at night and during periods of inclement weather.
  • Drivers should maintain at least three feet of separation from bicyclists.
  • Drivers should abstain from alcohol and other intoxicating substances.

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians and bicyclists. Pursuant to Illinois Vehicle Code (625 ILCS 5/11-601), no driver shall operate a vehicle at a speed greater than what is reasonable or safe given the prevailing conditions of the roadway. If a driver fails to slow down to avoid hitting a bicyclist, this could form the basis of a negligence claim. Victims of bicycle accidents tend to suffer very serious injuries including:

  • Broken bones
  • Head injuries
  • Organ damage
  • Lacerations

Many accident victims will not realize the full extent of their injuries for several weeks or months after any collision. They are often left with high medical bills and may need to take long amounts of time off of school or work. Any person that is injured in a bicycle accident may be able to seek some measure of justice through a civil claim.
