Liability for Injuries Caused by Lithium-Ion Batteries
Lithium-ion batteries are in literally tens of millions of products that get created and sold every year. They are also involved in a number of fires. According to USA Fire Protection, “at least 25,000 fire or overheating incidents in lithium-ion batteries occurred in a five-year period. Furthermore, heat, smoke, toxic gases, and the potential for explosions are all dangers associated with lithium-ion battery fires.” There are a number of common causes of lithium-ion battery fires.
- Lithium-ion batteries could easily catch fire if they are charged beyond the batteries voltage limit.
- Lithium-ion batteries could catch fire if the ambient temperature around the battery is too high. For example, these batteries should not be left out in the sun.
- Lithium-ion batteries could catch fire if they have poor battery management systems or charge to unsafe levels.
Companies that create consumer products have a legal obligation to ensure that they are reasonably safe. They must abide by all safety standards set by the Consumer Product Safety Commission. This is particularly important when it comes to batteries. There is an inherent fire risk if any battery system within a device explodes or malfunctions. If a design defect contributed to a battery malfunctioning, this could form the basis of a strict product liability claim. Victims of lithium-ion battery fires can suffer very serious injuries.
- Third-degree burns
- Smoke inhalation and lung injuries
- Organ damage
- Death
The vast majority of accidents involving lithium-ion batteries are preventable. In many cases, companies will cut corners in terms of safety in order to save a little bit of money. But these can often improve to be very dangerous. Another major problem is that products may get imported to the United States from areas with less stringent safety standards. It is important that accident victims understand that they do have legal rights. They may be able to seek some measure of accountability through a personal injury claim. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering.
