Liability for Taylor Ridge Semi-Truck Accidents

Truck drivers are required to obtain a commercial license and are expected to exercise a great deal of care to avoid hitting passenger vehicles. They must be particularly cautious when making turns at intersections. According to 625 ILCS 5/11-902, “The driver of a vehicle intending to turn to the left within an intersection or into an alley, private road, or driveway shall yield the right-of-way to any vehicle approaching from the opposite direction which is so close as to constitute an immediate hazard.” Several different factors could contribute to any semi-truck accident.

  • Fatigue: Truck drivers may naturally become fatigued if they are asked to work long hours or odd times of the day.
  • Blind Spots: Trucks have large blind spots that can easily obscure the presence of smaller vehicles.
  • Cargo Shift: Even a small amount of cargo shift in a commercial truck can substantially impair a truck driver’s ability to operate their vehicle safely.
  • Speed: Truck drivers are much more likely to be involved in a collision with passenger vehicles if they are traveling at higher speeds.

If a truck driver fails to slow down to avoid colliding with another vehicle, this could serve as evidence of negligence. Depending on the facts of any case, liability for a truck collision could extend beyond any specific driver determined to be at fault. The company that a truck driver worked for could bear some level of responsibility. As a general principle, employers can be liable for the negligent conduct of their workers who are operating within the course and scope of their job duties. A freight broker could also be liable for a collision if the truck company they were using has a poor safety record.

Evidence Preservations After Truck Accidents

Thousands of people are killed or seriously injured every year in preventable truck accidents. According to the Illinois Department of Transportation, “There were 11,294 crashes involving tractor-trailers in 2024. Fatalities resulting from tractor-trailer crashes decreased by 13.1% from 2023.” It is important that evidence is properly preserved after any truck accident.

  • The police report created after the accident should be collected. These reports can be enormously helpful, but they can also contain errors.
  • Any surveillance footage that may have captured the crash should be thoroughly reviewed.
  • Lots of photos of the accident site should be taken.
  • The event data recorder of the truck involved should be preserved.

Evidence is what will ultimately determine who could be liable for any truck accident. Unfortunately, truck companies will almost never hand over this evidence willingly. This is particularly true when it comes to the black box of any truck involved in a crash. Victims of truck accidents are protected by a number of laws. In particular, the family of any person killed in a truck accident is able to seek some measure of accountability through a wrongful death claim.
