Ogle County officials are saying that the accident took place around 3:15 PM on May 15. A vehicle driven by a 64-year-old man from Chicago was traveling west on Lanarc Road when it ran a stop sign before colliding with another vehicle.
That vehicle was operated by Brian Toepfer. Paramedics were called to the scene of the collision to help the injured victim.
Brian Toepfer was airlifted to a local hospital to receive treatment. A full investigation into the circumstances surrounding the crash remains ongoing at this time.
Liability for Forreston Car Accidents
Drivers must use care and obey all traffic regulations to avoid hitting other vehicles. According to Illinois Vehicle Code 625 ILCS 5/11-1204, “every driver of a vehicle and every motorman of a streetcar approaching a stop intersection indicated by a stop sign shall stop at a clearly marked stop line, but if none, before entering the crosswalk on the near side of the intersection.” There are many factors that could contribute to any collision where a driver goes past the stop sign.
- Drivers may have been intoxicated by a prescription medication or some other substance.
- Drivers may have been traveling too fast for the prevailing conditions.
- Drivers may not have been properly scanning the road in front of them.
- Drivers may not have checked their blind spots before proceeding through an intersection.
If a driver fails to stop at a stop sign before colliding with another vehicle, this could serve as evidence of negligence. There is a presumption of negligence on the part of any driver that goes past a yield sign without stopping. Liability for a car accident could extend beyond any particular driver determined to be at fault. For example, a city could bear some responsibility if they allowed vegetation to overgrow at a stop sign and block it from a driver’s view.
Injuries Associated With Illinois Car Accidents
Motor vehicle collisions can leave victims with very serious injuries. According to one study in the National Institutes of Health, “Neck sprain (33 %) was the most common injury among car occupants, multiple contusion and contusion of lower limbs among two-wheeled motor vehicles (23.5% and 14% respectively) and pedestrians (17.3% and 14.4% respectively) and upper limb fractures (20%) among cyclists.” There are many ways that car accidents can impact a person long after the actual crash.
- Victims of car accidents may experience a diminished earning capacity due to physical limitations placed upon them by their injuries.
- Many car accident victims suffer long-term psychological injuries, such as post-traumatic stress disorder.
- A number of accident victims may not be able to return to work for extended periods as they continue to heal.
It can be difficult to know where to begin after being injured in any truck accident. Car accidents are often the most traumatic experiences that most people go through. It is important that the victims of car accidents understand that they do have legal options. They are able to seek some measure of accountability through a civil claim. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering.
