Liability for Cook County Dog Attacks

Dog owners in Illinois are considered strictly liable for any incident where their dog attacks someone. According to Illinois Civil Code 510 ILCS 5/16, ā€œIf a dog or other animal, without provocation, attacks, attempts to attack, or injures any person who is peaceably conducting himself or herself in any place where he or she may lawfully be, the owner of such dog or other animal is liable in civil damages to such person for the full amount of the injury proximately caused thereby.ā€ There are many steps that dog owners should take to prevent dog attacks.

  • Dog owners should ensure that their animals are properly secured in their yard or within their home.
  • Dog owners should always have their animals on a leash, except in designated off-leash areas.
  • Dog owners should properly supervise their animal at all times.
  • Dog owners should socialize their animal at a young age to prevent them from becoming aggressive.

If a dog attacks someone, this could be used as evidence of negligence. It does not matter that the dog never expressed any type of vicious behavior in the past. There are limited exceptions for liability in the event that the person injured was provoking the dog in some way. There are also exceptions in the event that the person injured was trespassing. These types of incidents are nearly always preventable and involve situations where dogs are not being properly confined.

What to Do After Cook County Dog Attacks

Dog attacks are relatively common and leave many people seriously injured each year. According to CBS News, ā€œIn 2022, there were an all-time record 48,596 emergency visits for dog bites, a 12% increase from 2021. While dog bite deaths are rare, the study found 96 dog bite-related deaths across the country in 2022.ā€ There are many steps that should be taken after any dog attack.

  • The owners of the dog should be identified.
  • All medical records related to the attack should be preserved.
  • Any person that may have witnessed the attack should be interviewed.
  • The family of any person who died should seek the guidance of the team experienced in dog bite injury claims.

It can be difficult to know where to begin after any dog attack. Unfortunately, dog owners and insurance providers are not likely to ever accept responsibility when someone is seriously injured or killed. It is more likely that they will blame the victim. Victims of dog attacks are protected by a number of laws. They’re able to seek some measure of accountability and justice through a civil claim.
