Liability For DuPage County Bicycle Accidents
Riding a bicycle can be an excellent form of exercise. But bicyclists are uniquely exposed to many dangers including those posed by vehicles. According to Stanford Medicine, “Each year about 100 children are killed and 254,000 are injured as a result of bicycle-related accidents.” There are a number of steps that drivers should take in order to avoid hitting bicyclists.
- Drivers should check their blind spots when they are making turns.
- Drivers should slow down during periods of inclement weather.
- Drivers should continuously scan the road ahead of them for hazards.
All drivers must exercise due care in order to avoid hitting pedestrians and bicyclists. This includes driving at a safe speed. Pursuant to Illinois Vehicle Code (625 ILCS 5/11-601), no driver shall operate a vehicle at a speed greater than what is reasonable or safe given the prevailing conditions of the roadway. If a driver fails to slow down to avoid hitting a bicyclist, this could form the basis of a negligence claim.
Liability for a bicycle accident could extend beyond any negligent drivers. Pickup trucks are often used for commercial purposes in construction and landscaping. If the driver of a pickup truck was working at the time of a collision, their employer could be held at fault. Employers are typically liable for the wrongful acts of their employees – insofar as those employees were working within the course and scope of their job duties. There are several measures that should be taken after any bicycle accident.
- Eye witnesses should be interviewed.
- The police report for the crash should be examined.
- Victims should seek medical support.
- A thorough investigation should be conducted.
Many accident victims may not realize the full extent of their injuries for several days or weeks. Even after a person heals physically, victims of bicycle accidents often suffer from long-term psychological trauma. Any person that is injured due to the negligence of a driver may have legal recourse through a bodily injury claim. A civil claim can help with many of the expenses that often come with a serious collision.
