Liability for McHenry County Construction Accidents
The construction industry has one of the highest rates of worker injury and death in the United States. According to the U.S. Bureau of Labor Statistics, “In 2022, nearly 1 in 5 workplace deaths occurred in the construction industry and 38.4 percent of these deaths were due to falls, slips, and trips. The construction industry accounted for close to half, 47.4 percent, of all fatal falls, slips, and trips in 2022.” There are a number of measures that construction companies should take in order to prevent accidents.
- Construction companies should conduct regular safety meetings.
- Construction companies should ensure that all workers receive OSHA-compliant training.
- Construction companies should provide their workers with personal fall arrest systems when they work at heights above 6 feet.
- Construction companies should identify and eliminate as many potential hazards as possible.
When a worker is injured in Illinois, they will typically have recourse through the Worker’s Compensation system. The workers compensation system in Illinois is a no-fault insurance scheme. There is no need for an injured worker to demonstrate that one or more parties are at fault. In addition to workers compensation, an injured worker may be able to receive damages through a third-party liability claim. There are numerous sources of third-party liability at any construction site.
- The company that created a piece of machinery could be held at fault for an accident.
- A general contractor could be held at fault if a worksite was in a dangerous condition.
- Other companies operating within or around the site could also be held at fault if one of their workers caused an accident.
Construction accidents often leave workers with very serious injuries. In many cases, workers are injured in falls, or they are struck by falling objects. This may result in traumatic brain injuries that seriously impact a worker’s ability to continue working. It is important that victims of construction accidents understand that they do have legal rights. They are able to seek some measure of accountability through a civil claim.
