Liability for LaSalle County Car Accidents
Drivers have a legal obligation to exercise due care to avoid colliding with other vehicles on the runway. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-709, “A vehicle shall be driven as nearly as practicable entirely within a single lane and shall not be moved from such lane until the driver has first ascertained that such movement can be made with safety.” There are also specific requirements when it comes to driving through construction zones.
- Speed: According to Illinois Vehicle Code 625 ILCS 5/11-605.1, drivers must adhere to reduced speed limits when traveling through construction zones.
- Yield: Drivers must follow posted signs and yield to construction workers.
- Cellphones: It is illegal to use a cellphone in any Illinois construction zone, even if there are not workers actively present.
- Flaggers: Drivers must obey any flagger that is working in a construction zone.
Depending on the facts of any case, there could be numerous liable parties for any construction accident. If a driver was working at the time of a collision, their employer could be held at fault. As a general rule, employers are liable for the wrongful actions of their workers who were operating within the course and scope of their job duties. For example, a driver may have been transporting work equipment from one site to another.
Steps to Take After an Illinois Construction Accident
Far too many construction workers are seriously injured or killed every year in work zone accidents. According to the National Safety Council, “In 2023, 898 people were killed and 40,170 people were injured in work zone crashes. Work zone crashes are defined as taking place within the boundaries of a work zone or on an approach to or exit from a work zone due to activities, behaviors, or controls related to traffic moving through the boundaries of a work zone.” Several steps should be taken after any work zone accident.
- OSHA: The accident should be reported to OSHA as soon as possible. They can begin an extensive investigation into what caused the accident.
- Medical Evaluation: Victims should seek a thorough medical evaluation. Many of the injuries associated with car accidents will not be immediately obvious.
- Legal Support: Any person injured in a construction zone accident should seek the guidance of an experienced attorney.
Car accidents are often one of the most difficult and stressful experiences that people can go through. Victims may need to take extensive periods of time away from work to recover. They could also be left with high medical bills. It is essential that victims understand their legal options. Insurance companies are only concerned with making as much profit as possible by paying victims as little as possible.
