Liability for St. Clair County Truck Accidents
Truck drivers are required to obtain a commercial driver’s license. They must operate with an abundance of caution to avoid hitting other vehicles. To that end, they must always maintain a safe distance from other vehicles to prevent catastrophic accidents. According to 625 ILCS 5/11-710, “The driver of a motor vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of such vehicles and the traffic upon and the condition of the highway.” Truck companies should take several measures to prevent accidents with their drivers.
- Training: All truck drivers should receive ample training so that they will be prepared to handle all of the situations they will likely encounter.
- Maintenance: Truck companies should ensure that all of their vehicles are routinely inspected and well maintained. Trucks have a high utilization rate and are much more likely to break down if they are not regularly inspected.
- Technology: Technological features can help prevent many different types of truck accidents. For example, forward collision avoidance systems can automatically apply the brakes on a truck to prevent it from rear-ending cars and causing chain reaction collisions.
- Compliance: Every truck company should remain compliant with all FMCSA regulations. This includes hours-of-service enforcement.
Truck drivers are put under an enormous amount of pressure to complete their routes as quickly as possible. This can lead them to adopt unsafe driving habits. If a truck driver fails to slow down to avoid colliding with another vehicle, this may be construed as negligence. Depending on the facts of any case, there could be several liable parties for a motor vehicle collision involving a commercial truck.
Third-Party Liability for St. Clair County Truck Accidents
Thousands of people are seriously injured or killed every year in accidents with commercial trucks. According to the National Safety Council, “in 2023, 114,552 large trucks were involved in crashes resulting in an injury, a 4.7% decrease from 2022. Since 2016, the number of trucks involved in injury crashes has increased 12%, while the involvement rate per 100 million large truck miles driven has remained the same at 35.” A truck accident may involve liability on the part of several different entities.
- Truck Owner: Under Illinois law, the company that owns a truck or other vehicle could be responsible for an accident if they willingly let another person drive and they crashed.
- Truck Company: A company that owned a fleet of trucks and hired truck drivers could also be responsible for a collision. Generally speaking, employers can be held vicariously liable for the wrongful actions of their workers who were operating within the course of their job duties.
- Truck Manufacturer: Any company that manufactured a truck or other commercial vehicle could also bear some liability for a collision. This is particularly true when an accident is the result of designed defects with a truck or any of its component parts. For example, brakes on a truck may have failed.
- Cargo Loader: Trucks have very strict carrying capacities. If these capacities are exceeded, it could cause a driver to not be able to brake in time to avoid a crash. The company that loaded the truck could be responsible in this scenario.
Trucks are often highly complex events. The factors that contribute to any accident can take place hours, days, or even months beforehand. One common thread between nearly all truck accidents is that truck drivers and their insurance providers will virtually never accept responsibility for what happened. It is more likely that they will blame other parties. Victims of truck accidents in Illinois have a number of rights. These rights extend to the family of any person who died due to the negligent actions of a truck driver. They are able to seek some measure of accountability through a wrongful death claim.
