Crate & Barrel Hampshire Cribs Have Been Recalled Due to Fall Hazard To Children
CHICAGO, ILLINOIS (June 25, 2024) – Crate & Barrel has recalled its Hampshire Cribs line because they can pose a fall hazard for small children.
The recall was issued on April 25, 2024. Around 3,200 Hampshire Cribs were sold in the United States and Canada.
The issue with the cribs is that the support pins can become loose and allow the mattress to fall. Crate & Barrel has received 12 reports of the pins becoming loose.
No injuries have been reported thus far. The Crate & Barrel Hampshire Cribs came in four different colors, including blush, gray, white, and olive.
Liability for Crib Injuries
Incidents where children are injured by cribs are actually very common. According to one study by the National Institutes of Health, “An estimated 181,654 (95% confidence interval: 148,548-214,761) children younger than 2 years of age were treated in emergency departments in the United States for injuries related to cribs, playpens, and bassinets during the 19-year study period.” Children sustained a wide variety of different injuries in these accidents.
- Soft tissue injuries
- Fractures
- Head injuries
- Death
The company that manufactured a crib could be liable if a child is injured by their products. Companies that make consumer goods for children have a legal obligation to make sure that they are reasonably safe. To that end, they must follow all health and safety guidelines, including those by the Consumer Product Safety Commission. These companies should also consider all of the ways that children could potentially misuse their products.
When a company creates a product that has design defects, this could form the basis of a strict liability claim. Companies could also be liable for marketing defects associated with their products. A marketing defect occurs when a company fails to warn about the non-obvious dangers associated with the use of their product. There are a number of steps that should be taken after an incident involving a crib.
- Medical records should be preserved.
- It should be determined if the crib was part of a recall.
- A thorough investigation should be conducted.
- An experienced product liability attorney should be contacted.
The vast majority of accidents involving cribs are completely preventable. They tend to involve instances where product manufacturers fail to meet safety guidelines. Or a company may have failed to rigorously test their product in all the ways that it would be used. The family of any child that is injured by a crib may be able to seek some measure of justice through a civil claim. A product liability attorney can examine the unique facts of your case and let you know what your legal options are.
