Liability for Chicago Semi-Truck Accidents
Thousands of people are seriously injured or killed every year in hit-and-run car accidents. According to the AAA Foundation for Traffic Safety, “Hit-and-run crashes were 15% of all crashes in 2023 — the highest percentage recorded in any recent year. The study reveals a growing crisis on America’s roads, one that leaves injured people alone, without help and too often with no one to hold accountable.” Several factors could contribute to any semi-truck accident.
- Speed remains one of the leading causes of preventable hit-and-run collisions.
- Drivers are substantially more likely to be involved in collisions if they are intoxicated.
- Many hit-and-run collisions take place in the early morning and late evening hours when visibility is reduced.
- Hit-and-run collisions are more likely to occur at traffic intersections as drivers are making turns.
Every driver has a legal obligation to exercise care to avoid colliding with any pedestrian in the roadway. They must be particularly cautious when traveling through intersections. If a driver fails to slow down to avoid colliding with a pedestrian or other vehicle, this could serve as evidence of negligence. Drivers must maintain a safe speed given the road conditions. Even traveling the speed limit could be considered negligence, depending on several other factors.
If a semi-truck driver were involved in a crash, liability for the collision could extend beyond any specific driver determined to be at fault. The company that the truck driver was working for could also be liable. Generally speaking, employers can be vicariously liable for the negligent conduct of workers who are operating within the course and scope for their job duties. Victims of semi-truck accidents tend to suffer very serious injuries.
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
- Organ damage
Truck accidents tend to be highly preventable. They tend to involve situations where truck drivers are not properly scanning the road ahead of them. One of the factors that may contribute to accidents is pressure from carriers. They may place unreasonable demands on drivers to complete trips as quickly as possible. This often leads to major safety compromises. Any person injured in a semi-truck accident may have legal recourse through a civil claim.
