Liability for Chicago Car Accidents

Drivers have a legal obligation to operate their vehicle in a reasonably safe manner. They must observe all vehicle and traffic laws and take into consideration the prevailing road conditions. According to Illinois Vehicle Code 625 ILCS 5/11-503, “A person commits reckless driving if he or she: (1) drives any vehicle with a willful or wanton disregard for the safety of persons or property; or (2) knowingly drives a vehicle and uses an incline in a roadway, such as a railroad crossing, bridge approach, or hill, to cause the vehicle to become airborne.” Many different factors could contribute to a car accident.

  • Speeding: A driver may have been operating their vehicle at a speed that would be unsafe given the conditions they encounter.
  • Intoxication: Many drivers are involved in collisions due to their own intoxication. Even prescription medications can substantially impair a person’s ability to operate a vehicle safely.
  • Sharp Turns: Drivers are substantially more likely to lose control of their vehicle if they are making a sharp turn at an intersection.
  • Lane Changes: When a driver weaves in and out of traffic in an aggressive manner, this could easily contribute to them losing control.

If a driver fails to slow down to avoid colliding with another vehicle, this could serve as evidence of negligence. Liability for a collision could extend to several parties beyond any specific driver determined to be at fault. This could include any company that may have rented a McLaren or other luxury vehicle. A vehicle rental service could face liability for a collision under the theory of negligent entrustment. For example, they may have rented their vehicle to someone with a suspended license.

Steps to Take After Chicago Car Accidents

Many people are killed or seriously injured in preventable collisions each year. Speeding remains one of the leading causes of these accidents. According to the Illinois Department of Transportation, “Crashes involving speed accounted for 31.1% of total crashes, 45.3% of fatal crashes and 35.2% of injury crashes.” There are several steps that should be taken after any Chicago car accident.

  • All of the medical records related to injuries should be preserved.
  • The police report for the crash should be carefully reviewed. These reports can contain mistakes on occasion.
  • The owner of any vehicle involved in a crash should be determined. It matters whether or not the person involved in the crash was the actual owner.
  • The family of any person killed in a collision should seek an independent investigation by a team experienced in tort claims and accident reconstruction.

The vast majority of car accidents are preventable. They tend to involve drivers that are not properly scanning the road ahead of them. Unfortunately, drivers and their insurance providers almost never accept responsibility for collisions. This is true, even when police reports list them at fault. It is vital that car accident victims understand that they do have legal rights. They are able to pursue some measure of accountability through a wrongful death claim.
