Dorel Home Furnishings Issues Recall for Dorel Wall Beds Over Serious Injury Risk from Wall Detachment
CHICAGO, ILLINOIS (December 5, 2024) – Dorel Home Furnishings has issued a recall for its Dorel Wall Beds because they can pose a serious impact and crush hazard risk.
The recall was issued on November 21, 2024. Nearly 70,000 units were sold before the recall went into effect.
According to the recall notice by the Consumer Product Safety Commission, the wall beds can detach from the wall and fall onto any person nearby.
This can create a serious impact and crush hazard. Dorel Home Furnishings has received 22 reports of the bed falling.
This has led to at least 10 injuries, including concussions and abrasions. Prior to the recall, the beds could be sold at numerous online retailers, including Amazon and Walmart.
A full investigation into the incidents remains ongoing at this time.
Liability for Injuries Caused by Falling Furniture
Heavy furniture like dressers and beds tip over and seriously injure thousands of people every year. According to National Public Radio, “An estimated 18,000 Americans — nearly half of whom were children — went to emergency rooms across the U.S. in 2020 for injuries sustained when furniture, a TV or another appliance tipped over and hurt them.” There are a number of factors that contribute to wall-mounted beds tipping over.
- Weak Materials: Using drywall anchors instead of heavy-duty fasteners can lead them to fail.
- Inadequate Wall Anchoring: If the bed is not secured to the wall studs or a solid structure, it may become unstable.
- Worn or Defective Mechanisms: Over time, the pistons, hinges, or springs used to support a mounted bed can fail and lead to a collapse.
- Lack of Safety Features: A wall-mounted bed may have lacked adequate safety features such as safety straps and locking mechanisms.
Depending on the facts of any case, there could be numerous sources of liability for any injury caused by a falling bed. In particular, the company that manufactured the bed could be held at fault. Companies have a legal obligation to create products that are reasonably safe. They must adhere to all safety requirements set by the Consumer Product Safety Commission. If a wall-mounted bed lacked industry-standard safety features like safety straps, locking mechanisms, or stabilized legs, this could form the basis of a negligence claim in the event of an accident.
The company that installed a wall-mounted bed could also face some liability. Mounting a bed to the wall is not always a straightforward or easy task. Many people outsource this job to professionals. If the installers put the mounts directly into drywall or other loose material, this could easily lead to the bed failing over time. It could also leave them vulnerable to a civil claim. It is important that certain steps are taken after being injured by a piece of furniture.
- A report of the incident should be made.
- Victims should seek medical care as early as possible.
- It should be determined if the furniture was part of any recall.
- An experienced product liability attorney should be contacted.
It can be hard to know where to begin after being injured by furniture. Victims often suffer very serious and life-altering injuries that are expensive to treat. This is particularly true with those that suffer traumatic brain injuries. According to the National Institutes of Health, “costs per case were between $33,284 to $35,954 for mild and $25,174 to $81,153 for moderate TBI. These costs are mostly based on acute care.” Any person injured by a wall-mounted bed may be able to seek some measure of justice through a civil claim.
