Liability for Kane County Truck Accidents
Car accidents remained one of the leading causes of preventable injury and death in the United States. According to the IIHS, “Although the U.S. population has grown continuously since 1975, the rate of crash deaths per 100,000 people in 2022 was 38% lower than it was four decades ago. In 2022, the overall per capita death rate decreased 2.1% compared with 2021.” Drivers should take many measures to avoid causing accidents.
- Speed: Drivers should maintain their vehicles at a safe speed at all times. This may necessitate that they travel well below the stated speed limit.
- Scanning: Drivers should continuously scan the road ahead of them for potential hazards, especially during low-light conditions.
- Intoxication: Drivers should abstain from alcohol and other substances that could potentially impair their ability to operate a vehicle safely.
All drivers must use caution to avoid hitting any vehicle in the roadway. Pursuant to 625 ILCS 5/11-601, no vehicle shall be driven upon a highway at a speed greater than would be reasonable or safe given the prevailing conditions of the roadway. Drivers must take into consideration the possibility that animals act unexpectedly and may appear in front of them. There is a rebuttable presumption of negligence on the part of any driver that crosses into opposing lanes of traffic and hits another vehicle.
Depending on the facts of any case, liability for a car accident could extend beyond any at-fault driver. For example, many vehicles are used for commercial purposes. If the operator of a pickup truck was working at the time of a collision, their employer could potentially be held at fault. In most situations, employers are vicariously liable for the wrongful actions of their employees operating within their job duties. It is critical that evidence be properly preserved after any car accident.
- A police report of the incident should be created.
- Photos of the accident site should be taken.
- Surveillance footage that may have captured the crash should be collected.
- Medical records related to injuries should be preserved.
Car accidents are often highly preventable. In fact, it has been estimated that nearly 93% of all collisions involve some amount of human error. This often includes situations where drivers are simply not scanning the road ahead of them properly for potential hazards. Accident victims should understand that they do have rights. These rights extend to the family members of those killed in collisions. The family of any person who died in a collision due to the negligence of another driver may be able to seek some measure of accountability through a wrongful death claim.
