In Motion Design Issues Recall for Evermore Surprise Egg – Yellow Wrap Due to Risk of Serious Injury From Lead Contamination

CHICAGO, ILLINOIS (October 10, 2024) – In Motion Design has issued a recall for its Evermore Surprise Eggs because they can pose a serious risk of lead contamination for young children.
The recall was issued on October 2, 2025. Roughly 98,350 units were sold prior to the recall.
According to the Consumer Product Safety Commission, the toy airplane inside of the egg contains levels of lead that exceed federal limits. Lead can be particularly toxic for young children.
The Evermore Surprise Eggs were sold in a variety of stores, including 7-Eleven, Horizon, Speedway, and Murphy stores. They were manufactured in China.
Liability for Injuries Associated With Consumer Products
Companies that create children’s products have an obligation to ensure that they are safe. They should be free from known contaminants and abide by all federal regulations related to dangerous substances. If a company fails to ensure that their product is not contaminated with lead or other chemicals, this could form the basis of a product liability claim. There are many serious issues associated with lead poisoning.
- Neurological and cognitive effects
- Blood disorders
- Hearing loss
- Kidney damage
- Learning disabilities
There are many reasons that a children’s product may contain lead. There could be some type of contamination during the manufacturing process. This is why it is so important that companies test their products at all levels of production. It is also possible that toys get imported into the United States from countries that do not have as strict safety regulations.
Steps to Take After Injuries Involving Lead-Contaminated Children’s Toys
Many toys sold to consumers in the United States contain lead and other harmful substances. According to IPEN, “Children’s toys that are sold in the country contain high level of toxic heavy metals and other harmful chemicals, a recent study has revealed. The study by the Centre for Public Health and Environment Development (CEPHED), whose results were released on Monday, found dangerous level of heavy metals and other chemicals in 62 percent of the toy samples collected from different parts of the country.” It is important that parents take certain steps if their child has been exposed to lead-contaminated toys.
- Medical Evaluation: The child should undergo a thorough medical evaluation. This should include ongoing monitoring. Many of the injuries associated with lead contamination will not be immediately obvious.
- Product Review: The toy or product involved should be stored in a safe location so that it can be examined at a later time. It should also be determined if the toy was on any recall list.
- Legal Review: Parents should also consult an experienced product liability attorney. An attorney can take steps to preserve evidence and protect your legal rights.
The vast majority of incidents involving contaminated children’s toys are entirely preventable. They tend to be the result of clear safety violations. Unfortunately, the companies that sell these contaminated products will almost never accept responsibility. They will blame vendors or other third parties. It is important for parents to understand that they do have legal rights in these situations. They are able to seek some measure of accountability through a product liability claim.
