Liability for Braidwood Semi-Truck Accidents
Truck drivers are required to obtain a commercial driver’s license and are expected to operate with an abundance of caution to avoid hitting other vehicles in the roadway. Many collisions involve semi-trucks that make dangerous lane changes. According to Illinois Vehicle Code 625 ILCS 5/11-709, “A vehicle shall be driven as nearly as practicable entirely within a single lane and shall not be moved from such lane until the driver has first ascertained that such movement can be made with safety.” There are many ways that a truck driver may have acted negligently prior to a crash.
- A truck driver may have failed to check their blind spots before changing lanes or making turns.
- A truck driver may have failed to scan the road ahead of them for potential hazards.
- A truck driver may have violated hours of operation requirements.
- A truck driver may have operated their vehicle while under the influence of a substance that impairs their ability to concentrate or drive safely.
If a truck driver fails to slow down to avoid colliding with a motorcycle or other vehicle, this could serve as evidence of negligence. Liability for a truck collision could extend beyond any specific truck driver. For example, the company that owned the truck or employed the driver could also be liable for a collision. Under Illinois law, employers are vicariously liable for the negligent actions of their workers who are operating within the course and scope of their job duties. However, truck companies will often employ truck drivers as independent contractors to avoid direct liability for collisions.
Steps to Take After Braidwood Semi-Truck Accidents
Car accidents remain a major cause of preventable injury and death in Illinois. According to the Illinois Department of Transportation, “In 2023, there were 299,133 crashes involving motor vehicles in Illinois. Injury crashes accounted for 20.6% of these crashes (61,547), while fatal crashes (1,142) accounted for less than 1.0% of these crashes.” It is important that certain actions are taken after any Illinois truck accident.
- Police: The police should be called to the scene of the collision to begin investigating. The police report that they create can be enormously useful in helping to determine what went wrong.
- Eyewitnesses: Any person who may have witnessed the collision should be interviewed early on while their memories are still fresh.
- Event Data Recorder: Most trucks come equipped with a device known as an event data recorder. This device captures critical information about how a truck was being operated prior to a crash. It is vital that the information from this device is captured and preserved.
- Independent Review: The family of any person who died in a truck accident should seek an independent review of the collision by a team experienced in accident reconstruction and negligence claims. This team can help identify all potentially responsible parties.
The vast majority of truck accidents are totally preventable. They tend to involve situations where traffic laws are not being strictly followed. One of the major issues is that truck companies may push their drivers to complete delivery routes as quickly as possible. This can lead to drivers adopting poor driving habits. The family of any person who died in a truck accident may be able to seek some measure of transparency and accountability through a civil claim.
