Liability for Injuries Involving Consumer Products

Many people are injured every year in accidents involving fitness equipment. According to BMJ Journals, “Approximately 70 302 (95% CI 59 086 to 81 519) mechanical exercise equipment-related injuries presented to US EDs nationally during 2007–2011, of which 66% were attributed to treadmills.” Companies that manufacture gym equipment should take a number of measures in order to ensure that their products are safe.

  • Material Choice: Companies should use durable materials that are not likely to break or fracture after repeated use.
  • Testing: Companies should ensure that their products are safe through rigorous testing of all the ways that those products may likely be used and even misused.
  • Compliance: Companies should adhere to all safety requirements from all state and federal agencies.

Companies have a legal obligation to ensure that all of their products are reasonably safe. They must also warn consumers about the non-obvious dangers associated with the use of their products. If a piece of gym equipment has a design defect that is likely to contribute to an injury, this could form the basis of a strict product liability claim. A design defect may be present if similar products are not likely to malfunction in the same ways.

There have been a number of lawsuits after people have been injured by defective gym equipment. Consider, for example, Bostick v. Flex Equipment Co. (California, 2007). A man suffered severe injuries after using a piece of weightlifting equipment at Gold’s Gym. A jury found that the equipment manufacturer was 90% liable for the plaintiff’s injuries. In particular, the company failed to warn users about the potential hazards associated with their product. Victims of gym equipment accidents tend to suffer very serious injuries.

  • Broken Bones: Gym equipment often involves heavy weights that can easily break bones in the hands or other parts of the body.
  • Head Injuries: Any weighted object that falls on a person’s head could result in a traumatic brain injury.
  • Soft Tissue Damage: It is also common for people to sustain soft tissue damage if a piece of gym equipment exerts a great deal of force across the user’s body.

It can be difficult to know where to begin if you’ve been injured by a piece of gym equipment. In far too many circumstances, accident victims may blame themselves for being injured. But the fact of the matter is that many of the injuries that occur are due to poorly designed products. It is important for victims of gym equipment accidents to understand that they do have legal options. They’re able to seek some measure of accountability through a personal injury claim.
