Liability for Hyde Park Chemical Accidents

Business owners in Illinois have a legal obligation to protect guests from foreseeable sources of harm. To that end, they must maintain their premises in a reasonably safe condition at all times. They must also follow all safety regulations related to whatever industry they happen to be in. In particular, there are a number of measures that gyms and swim schools should take to prevent accidental chemical exposure.

  • Storage: All chemicals at the facility should be stored in secure locations that are locked and inaccessible to students and other guests. These locations should be well-ventilated, and all chemicals should be clearly labeled.
  • Supervision: Only trained employees and authorized staff should have access to areas where chemicals are being kept.
  • Training: Only trained employees should be allowed to disperse pool chemicals. These chemicals should never be mixed or tampered with in any way beyond manufacturer specifications.
  • Emergency Response: Gyms and swim schools should create a written emergency plan in the event of chemical leaks or gas releases. Evacuating everyone to safety should always be top priority.

If an employee at a swim school or other business mishandles chemicals and causes an exposure incident, the company that they work for could be held liable. Generally speaking, employers can be held vicariously liable for the wrongful actions of their workers who were operating within the course and scope of their job duties. There could also be several additional sources of liability. A piece of pool equipment may have malfunctioned and potentially caused a chemical leak.

Steps to Take After Chemical Exposure Accidents

Many people are injured every year in chemical exposure accidents. Many of the victims are workers. According to OSHA, “workers suffer more than 190,000 illnesses and 50,000 deaths annually related to chemical exposures. Workplace chemical exposures have been linked to cancers, and other lung, kidney, skin, heart, stomach, brain, nerve, and reproductive diseases.” Several actions should be taken after any person is injured in a chemical exposure accident.

  • Victims should receive a thorough medical evaluation as early as possible.
  • Victims should keep all medical records related to their treatment.
  • Any police report related to the incident should be sought and carefully reviewed.
  • Victims should contact an experienced premises liability attorney.

Most chemical exposure accidents are usually highly preventable. They tend to involve clear safety lapses. This can include instances where untrained workers put too many chemicals into a pool. It is important that the victims of these accidents understand that they do have legal options. They are able to pursue some measure of justice and accountability through a personal injury claim.
