Liability for Warren County Garbage Truck Accidents
Every driver operating a commercial vehicle has a legal obligation to scan the road ahead of them and exercise due care to avoid collisions. This requires that they maintain a safe speed at all times. According to Illinois Vehicle Code 625 ILCS 5/11-601, “No vehicle may be driven upon any highway of this State at a speed which is greater than is reasonable and proper with regard to traffic conditions and the use of the highway, or endangers the safety of any person or property.” Drivers should take several other actions to avoid collisions.
- Driver should maintain an adequate follow distance with all vehicles ahead of them.
- Drivers should be well rested before heading out onto the road.
- Drivers should abstain from alcohol and other intoxicating substances.
- Drivers should ensure that their vehicles are periodically inspected and well maintained.
If the driver of a garbage truck fails to slow down to avoid colliding with a vehicle, this could serve as evidence of negligence. Depending on the facts of any case, there could be several liable parties for any car accidents. This includes the driver of a passenger van. Any passenger van that is transporting people for a fee is considered a common carrier and must exercise the utmost caution to avoid collisions. The company that a driver worked for could also be held at fault. Generally speaking, employers can be liable for the negligent actions of their workers who are operating within the course and scope of their job duties.
