Liability for West Pullman CTA Bus Accidents
Chicago Transit Authority buses are considered common carriers under the Common Carrier Liability Act (740 ILCS 25/). Their drivers must operate with an abundance of caution to avoid hitting vehicles. This necessitates that they maintain a safe speed at all times. According to Illinois Vehicle Code 625 ILCS 5/11-601, “No vehicle may be driven upon any highway of this State at a speed which is greater than is reasonable and proper with regard to traffic conditions and the use of the highway.” There are many reasons that buses can be particularly dangerous.
- Buses have large blind spots that can obscure the presence of smaller vehicles.
- Buses have a wide turning radius, which makes side-impact collisions more likely.
- Buses can weigh tens of thousands of pounds and are dangerous even at lower speeds.
Depending on the facts of any case, there could be several liable parties for any collision. This includes the operator of a tow truck or another vehicle. If a driver fails to slow down to avoid colliding with another vehicle, this could form the basis of a negligence claim. Liability for a collision could extend beyond any single driver determined to be at fault. This could include the company that operated a commercial vehicle like a tow truck or a bus.
Steps to Take After Illinois Bus Accidents
Many people are seriously injured each year in bus accidents. According to The Journalist’s Resource, “about 63,000 buses [of all kinds] are involved in an accident each year; about 14,000 result in an injured person, and 325 result in a fatal injury. About 50 passengers (including the driver) are killed, on average, in a given year.” Multiple steps should be taken after any Illinois bus accident.
- Victims should seek a thorough medical evaluation. Many of the injuries associated with a collision will not be immediately obvious.
- Any person that may have witnessed the crash should be interviewed while their memories are still fresh.
- Surveillance footage that may have captured the accident should be sought.
- A person injured in a Chicago bus accident should seek the guidance of an experienced personal injury attorney.
It can be difficult to know what where to begin after any motor vehicle collision in Chicago. Victims are often left with life-altering injuries and maybe burdened with high medical bills. To make matters worse, insurance providers will virtually never accept responsibility when someone is seriously injured. They are more likely to blame other third parties. Any person injured in a Chicago collision with a tow truck or bus may be able to seek some accountability through a personal injury claim.
