Liability for Illinois Forklift Accidents
When a worker is injured in Illinois, they will typically have recourse through the workers’ compensation system. Workers’ compensation in Illinois operates through a no-fault insurance scheme. There’s no need for an injured worker to demonstrate that one party or another acted negligently. Having said that, employers still have a responsibility to maintain their premises in a reasonably safe condition to prevent accidents. In particular, several steps should be taken to prevent forklift accidents.
- Employers should ensure that only workers with the required certifications operate forklifts.
- To the greatest extent possible, pedestrians should be separated from forklifts.
- Forklifts should be routinely inspected and well maintained. They should have audible backup alarms and horns.
- All workers that operate forklifts should receive extensive training.
Depending on the facts of any case, an injured worker may have recourse beyond the workers’ compensation system. Any person injured in a forklift accident may be able to pursue damages through a third-party liability claim. A third-party liability claim may be possible if an entity separate from a worker’s employer contributed to an accident. For example, the company that manufactured a forklift could be liable for an accident if it was defective in some way. A business owner could also be liable for an accident if they failed to maintain their premises in a reasonably safe condition.
Steps to Take After Illinois Forklift Accidents
A number of workers are seriously injured or killed every year in accidents involving forklifts. According to the National Safety Council, “Forklifts were the source of 67 work-related deaths in 2023 and 24,960 DART cases that include 15,480 DAFW cases in 2021-2022.” It is important that any person injured in a forklift accident take certain steps.
- Victims should seek a medical evaluation as early as possible. Even seemingly minor injuries can turn out to be much more serious.
- The OSHA report created after the incident should be carefully reviewed. It can help reveal major safety lapses that contributed to the accident.
- Any person injured in a forklift accident should seek the legal guidance of an experienced attorney. An attorney can examine the unique facts of any case and let victims know if they have an actionable claim that can move forward.
It can be hard to know what to do if you’ve been injured in any workplace accident. Many workers are burdened with traumatic injuries that impair their ability to perform their job duties. They may also be saddled with high medical bills. Workers that are injured on the job in Illinois are protected by a number of laws. They may be able to pursue damages through a personal injury claim.
