Liability For Chicago Car Accidents
Many people are injured in accidents involving Uber and Lyft vehicles every year. According to a review of one study in Science, “[The study] concludes that the arrival of ride-sharing was associated with a 2% to 3% increase in the number of car occupants and pedestrians killed in accidents between 2011 and 2016.” There are a number of common causes of rideshare accidents.
- Speeding is a factor in the majority of car accidents.
- Collisions are more likely to happen in dense urban areas and at intersections.
- A large portion of car accidents involve a driver who is intoxicated.
All drivers have a legal obligation to exercise due care in order to avoid collisions. They must be particularly cautious when around emergency vehicles. When a police officer is responding to an emergency with their lights and sirens on, drivers must take action to avoid colliding with this vehicle. When rideshare vehicles fail to take action to avoid colliding with emergency vehicles, this could form the basis of a negligence claim. Victims of car accidents tend to suffer very serious injuries.
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
Whether or not Uber or Lyft could be on the hook for a rideshare collision will depend on the circumstances of the crash. For example, if a rideshare driver was offline and not transporting a passenger, Uber and Lyft insurance policies typically wouldn’t apply. When a driver has the app turned on and is transporting a passenger, Uber and Lyft insurance policies will typically cover any person injured. It is important for accident victims in these situations to understand that they do have rights.
