Liability For Attacks In Gurnee
Theme parks are supposed to be places where individuals and families can relax and enjoy time off. But far too often, guests have to deal with outbursts of violence. According to Science Daily, “Crime rates are likely to be higher in neighbourhoods near theme parks which are major tourist attractions, according to new findings published in the peer-reviewed journal Justice Quarterly.” There are a number of steps that theme parks can take to prevent fights inside of the park.
- Theme parks should have security measures like cameras.
- Theme parks should have security guards on staff.
- Theme parks should intervene quickly to diffuse violence.
Depending on the facts of any case, a theme park could be liable if someone is injured in an attack at the park. Pursuant to Illinois Civil Code (740 ILCS 130/1), property owners must maintain their property in a reasonably safe condition. This includes taking steps to protect guests from violent crimes. Businesses that are in high-crime areas will typically need greater security measures than other businesses. When a business or government entity fails to take reasonable measures to prevent attacks, this could form the basis of a negligence claim. Victims of violent crime often suffer very serious injuries including:
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
- PTSD
It can be hard to know where to begin after any instance of violent crime. Many victims may not realize the full extent of their injuries for several weeks or months after an attack. Any person that is assaulted at a theme park may be able to seek some measure of accountability through a civil claim. It is important that all evidence is properly preserved after any attack.
