Liability for Attacks at Illinois High Schools
Schools have a legal obligation to protect students from foreseeable sources of harm. This includes protecting them from assaults caused by third parties, teachers, and even fellow students. In many instances, assaults at schools are preventable with the right safety protocols in place. Schools should take a number of steps to prevent students from being attacked or otherwise harmed by other students.
- Red Flags: Schools should be able to identify the red flags that will typically precede any fight. This will include prior fights or threats, bullying, and behavioral outbursts.
- Supervision: Schools must properly supervise students at all times of the day. This includes on school playgrounds, in the bathrooms, and in the hallways between classes.
- Discipline: Schools must use the appropriate discipline to minimize any type of violent conduct. If students are able to get away with misbehaving, they will likely be emboldened.
- Separation: When a student has threatened or bullied another student, the school must intervene with appropriate measures. This may include expelling or suspending the perpetrator. It may also include physically separating the two students.
Adequate supervision is perhaps the most important part of keeping students safe at all times. The mere presence of a teacher or school faculty member automatically decreases the likelihood that students will attack each other. If a school fails to supervise students and shows a reckless disregard for their safety, this could form the basis of a negligence claim.
Steps to Take After Attacks at Illinois Schools
Students are routinely the victims of bullying and other forms of violence in a school setting. According to the Illinois Criminal Justice Information Authority, “In 2019, YRBS data indicated 15.7% of U.S. high school students reported being electronically bullied that past year, while 16.0% of Illinois high school students reported being electronically bullied. Furthermore, 19.5% of U.S. high school students and 19.9% of Illinois high school students reported being bullied in school.” It is important that victims of school violence take certain steps to protect their health and legal rights.
- Medical Attention: Victims should seek medical support as early as possible. Many of the injuries associated with an assault may not be immediately obvious. Moreover, it is common for victims to suffer long-term psychological trauma after being attacked in school.
- School Records: All of the school records related to the incident should be collected and reviewed. The school’s written policies related to misconduct should also be reviewed.
- Legal Support: The parents of any child injured in a school assault should seek the legal guidance of an experienced personal injury attorney. Damages in a civil claim can help cover many of the expenses associated with a traumatic injury.
School assaults do not happen in a vacuum. They tend to be the result of an accumulation of misconduct and escalating altercations between two students. Verbal fights can easily turn physical if teachers do not adequately supervise students and intervene. Unfortunately, schools will virtually never accept responsibility if one of their students is attacked and seriously injured during the school day. This is why it is so important that these incidents are investigated by experienced attorneys.
