OleOleToy Glow in Dark Party Supplies Toy Sets Sold Exclusively On Amazon Recalled Over Violation of Federal Regulations for Battery-Operated Toys
CHICAGO, ILLINOIS (September 13, 2024) – Glow in Dark Party Supplies Toy Sets sold by OleOleToy were recalled because they can pose an ingestion hazard for children.
The recall was issued on August 29, 2024. Around 984 units were sold. The problem with the toy sets is that they violate federal battery-operated toy regulations.
In particular, the Bunny Ears Headbands contain button cell batteries. When these batteries are swallowed, they can cause serious injuries and internal chemical burns.
Prior to the recall, the Glow in Dark Party Supplies Toy Sets from OleOleToy were sold exclusively on Amazon. No injuries have been reported thus far.
Liability For Injuries Caused By Battery-Operated Toys
Many children are injured every year after ingesting toy batteries. According to the National Safety Council, “If swallowed or placed in the nose or ears, button batteries can cause serious injury or death. More than 3,500 people of all ages swallow button batteries every year in the United States. Most pass through the body and are eliminated, but sometimes they get hung up in the esophagus.” There are a number of measures that parents can take to keep their children safe.
- Parents should identify items in the home that may contain button batteries.
- When possible, parents should select batteries in child-resistant packaging.
- Parents should keep spare batteries locked away.
- Parents should be mindful of toys that may contain button batteries.
All companies have a legal obligation to create products that are reasonably safe. At a minimum, they must comply with all federal safety regulations. When a company creates a toy that violates battery safety regulations, this could form the basis of a strict liability claim. It is crucial that certain steps are taken after any injury involving a defective toy.
- Medical records related to the injury should be preserved.
- It should be determined if the toy was part of any recall.
- An experienced product liability attorney should be contacted.
It can be hard to know where to begin after any injury involving a defective toy. Children may face life-long complications from swallowing batteries. Sadly, though, companies will often do everything in their power to evade responsibility if a child is injured by an unsafe product. The parent of any child injured by an unsafe toy may be able to seek some measure of justice through a civil claim.
