GOETAS Pool Drain Covers Were Recalled Over Entrapment Hazard Concerns, Violation of Virginia Graeme Baker Pool and Spa Safety Act
CHICAGO, ILLINOIS (September 18, 2024) – GOETAS Pool Drain Covers have been recalled over concerns that they can pose an entrapment hazard to people.
The recall date was listed as September 12, 2024. Around 2,500 units were sold. The recalled drains do not conform with regulations of the Virginia Graeme Baker Pool and Spa Safety Act (VGBA).
Consequently, these devices can pose an entrapment hazard to swimmers. No injuries have been reported at this time.
The devices were originally manufactured in China and sold exclusively on Amazon by Goetas.
Liability For Injuries Caused By Consumer Products
Deaths and injuries involving consumer products are very common. According to the Consumer Product Safety Commission, “Every year consumer products are involved in the deaths of an estimated 23,000 Americans and injuries to 31 million others. These injuries, deaths, and associated property damages cost the American public billions of dollars annually.” Since 1990, around 130 people have become entrapped by pool drains, resulting in 27 deaths. To prevent this, companies must adhere to the Virginia Graeme Baker Pool and Spa Safety Act.
- Mandatory Use of Anti-Entrapment Drain Covers: All public pools and spas are required to use drain covers designed to prevent entrapment.
- Single Drain Systems: Pools and spas with a single drain must ensure that those devices incorporate certain safety features, including Safety Vacuum Release Systems (SVRS) or Gravity Drainage Systems.
- Federal Compliance: The Virginia Graeme Baker Pool and Spa Safety Act also applies to public pools and spas.
Companies have a legal obligation to create products that are reasonably safe. Among other things, they must comply with federal and state regulations. This includes safety standards set by the Consumer Product Safety Commission. When a company makes a product with design defects that result in consumers being injured, this could form the basis of a strict liability claim. It is important that certain steps are taken after any injury involving a consumer product.
- Medical records related to the injury should be preserved.
- It should be determined if the device involved was part of any recall.
- An experienced product liability attorney should be contacted.
It can be hard to know what to do after any injury involving a consumer product. To make matters worse, the companies that make these products will do everything in their power to deny responsibility. They may blame outside installers or allege that the consumer used the product improperly. This is why it is so important for accident victims to seek legal counsel early on. A product liability attorney can examine all of the unique facts of your case and let you know what your legal options are.
Getting Legal Help For Injuries Involving Consumer Products
We at Horwitz Horwitz & Associates were very concerned to hear about the safety issues with the GOETAS Pool Drain Covers. It is problematic that so many consumer products that violate safety standards are being sold by Amazon and other online retailers.
