Liability for Wadsworth Motorcycle Accidents

All drivers have a legal responsibility to use caution to avoid causing accidents. Many accidents are caused by drivers that make dangerous left turns. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-801, the driver of any vehicle intending to turn left must yield the right-of-way to any driver traveling from the opposite direction that is close enough to pose a hazard. If a driver makes a left turn into the path of another vehicle, this could be construed as negligence. Several factors could contribute to a car accident.

  • Driver Distraction: Many drivers are distracted before they make left turns. It can be difficult to focus on traffic coming from two directions at intersections.
  • Driver Intoxication: Another major cause of car accidents is driver intoxication. Drivers can be intoxicated by a variety of substances, including over-the-counter medications.
  • Inclement Weather: Poor weather conditions can obscure the presence of other drivers and make roadways more slick.

There could be several liable parties for any car accidents. This includes the driver responsible for the crash. It is also possible that several drivers may bear some liability. A city could also be legally responsible for a collision if it was the result of a dangerous condition on public property.  It is critical that all evidence related to a crash be properly preserved. This can help reveal all parties that could be responsible.

Steps to Take After Illinois Motorcycle Accidents

Many people are injured or killed in motorcycle accidents each year. According to the National Safety Council, “Although motorcycles make up only 3% of all registered vehicles and 0.6% of all vehicle miles traveled in the United States, motorcyclists accounted for 15.5% of all traffic fatalities and 3.4% of all injuries in 2023.” Several measures should be taken after any motorcycle accident.

  • Police Report: The police should be called to the scene of the collision as soon as possible so that they can investigate.
  • Medical Evaluation: Victims should seek a medical evaluation. Many of the injuries associated with a serious collision may not be immediately obvious.
  • Legal Support: Victims of motorcycle accidents should strongly consider speaking with experienced legal counsel.

Any person injured due to the negligent actions of another driver may be able to seek some measure of accountability through a civil claim. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering. An attorney can examine the unique facts of your case and let you know what your legal options are.
