Liability for Tinley Park Car Accidents
Every driver in Illinois must use caution to avoid colliding with other vehicles. It requires that they maintain a vehicle at a safe speed and abide by all traffic regulations. This is particularly important when any vehicle is traveling through an intersection. According to Illinois Vehicle Code 625 ILCS 5/11-902, the driver of any vehicle intending to turn left must first yield the right-of-way to any vehicle that is approaching from the opposite direction and close enough so as to pose a hazard. There are many different ways a driver may have failed to prevent a car accident.
-
A driver may have failed to check their blind spots before initiating a return at an intersection.
-
A driver may have failed to consider approaching vehicles since they change lanes.
-
A driver may have been distracted by looking at their cellphone or reaching for a fallen object.
-
A driver may have been traveling too fast for the prevailing road conditions.
If a driver fails to maintain adequate separation from a motorcycle before colliding with it, this could serve as evidence of negligence. It is possible that there could be several liable parties for any motor vehicle collision. This includes the person who owned the truck. In many cases, this person’s identity could be separate from the driver. A public or private business entity may also bear some responsibility for a collision. This is particularly true if a pickup truck or other vehicle was being used for some type of commercial purpose.
Determining How an Accident Took Place
Car accidents are often highly complex events. The factors that contribute to any specific collision could take place many days or hours beforehand. This is why accident reconstruction is so important. According to the NHTSA, “After a crash has been sampled, trained Crash Technicians obtain data from crash sites by documenting scene evidence such as skid marks, fluid spills, and struck objects. ” There are many ways that evidence can help reveal how an accident took place.
-
Braking: A lack of skid marks in the roadway can help reveal that a driver did not attempt to brake prior to a collision.
-
Event Data Recorder: Many vehicles come equipped with an event data recorder. This device contains critical information about how a vehicle is used and whether or not a driver may have been speeding prior to a crash.
-
Medical Records: The nature of a person’s injuries can help reveal how the crash took place, even in the absence of surveillance footage.
-
Police Report: The police report created after a crash is an officer’s best estimate of what happens. These reports are far from thorough and may contain errors. But they can still be quite useful.
Depending on how any accident took place, there could be several liable parties. Unfortunately, negligent drivers and their insurance providers will almost never step forward and accept responsibility when they cause a collision. This is why it is so important that these incidents are properly investigated by an outside source. Ultimately, evidence is what will help reveal how any crash took place, regardless of what any individual or insurance provider may claim.
