Liability For DeKalb Car Accidents

Car accidents remain one of the leading causes of serious injury and death for workers in the United States. According to the Centers For Disease Control, “In 2020, 1,038 U.S. workers driving or riding in a motor vehicle on a public road died in a work-related crash (22% of all work-related deaths). Motor vehicle crashes are the 1st or 2nd leading cause of death in every major industry group.” There are a number of factors that could potentially contribute to a car accident.

  • Poor road conditions
  • Inclement weather
  • Speeding
  • Driver fatigue

When a worker is injured or killed on the job, they or their family will typically have recourse through a worker’s compensation claim. Worker’s compensation is a no-fault insurance scheme designed to protect workers injured on the job. A worker or their family may also have recourse through a third party liability claim. A third party liability claim may be possible when an entity separate from a worker’s employer causes a collision.

All drivers have a legal obligation to exercise due care in order to avoid collisions. No person shall drive in the opposite lanes of traffic. There is a rebuttable presumption of negligence on the part of any driver that crosses a center median and collides with another vehicle. Victims of head-on collisions tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

It can be difficult to know where to begin after any collision. But it is important for accident victims to know that they do have rights. The family of any worker that is killed may have legal recourse through a civil claim. However, drivers will often fight hard to deny liability for any accident that they are involved in. This is why it is so important that all evidence is properly preserved after an accident.
