Liability for Fires Caused by Battery Chargers
Fires caused by battery chargers and other products with lithium-ion batteries are actually quite common. This is true all over the world. According to RNZ, “Fire and Emergency are warning people to be mindful of the products they purchase over the summer period with lithium batteries after the number of fires has doubled in four years. Data shows numbers have ballooned from 51 fires in 2020 to 104 this year as of 22 November.” There are a number of factors that could contribute to a lithium-ion battery fire.
- A lithium-ion battery may have damage to the separator that can lead to direct contact between the cathode and anode.
- An internal short circuit can lead to thermal runway, which is an uncontrollable chain reaction that increases the temperature of a battery.
- Impurities within the battery may result in misaligned components or weak separators.
When a battery has design defects that trigger a fire, this could form the basis of a product liability claim. Product liability claims can be based on negligence, strict liability, or breach of warranty. When claims are based on negligence, there could be design defects, marketing defects, or manufacturing defects. Both manufacturers and suppliers could incur liability for a defective product. It is important that certain steps are taken after any lithium-ion battery fire.
- It should be determined if the product involved was part of any recall.
- A thorough investigation should be conducted.
- A police report may need to be created.
- Medical records related to the incident should be preserved.
- An experienced product liability attorney should be contacted.
It can be hard to know where to begin after a lithium-ion battery fire. Many victims lose all of their worldly possessions. They may also have to contend with serious injuries and high medical bills. To make matters worse, companies that make defective products will virtually never accept responsibility for fires caused by those products. This is where a product liability attorney can help you.
