Liability for Illinois Semi-Truck Accidents
Truck drivers in Illinois must obtain a commercial license and operate with an abundance of caution to avoid collisions. Pursuant to 625 ILCS 5/11-907, drivers must use caution, move over, and reduce their speed when approaching any stationary vehicle that has warning lights, including vehicles that are in construction zones. There are several ways a truck driver may have failed to uphold their duty of care.
- Speeding: A truck driver may have been speeding through a construction zone.
- Distracted: A truck driver may have been distracted by their phone or some other device.
- Intoxicated: A truck driver may have been impaired by any number of substances, including prescription medications.
When a truck driver fails to use proper precautions to avoid a collision, their employer could potentially be held liable for any crash. As a general principle, employers within the state of Illinois are held vicariously liable for the wrongful actions of their employees–insofar as those workers were operating within the course and scope of their job duties.
Legal Options After an Illinois Workplace Accident
When a worker is injured on the job in Illinois, they will have several options to receive aid. For the most part, workers will be able to seek compensation from the workers’ compensation system. An injured worker may be able to pursue additional damages through a third-party liability claim.
- Workers’ Compensation: Workers’ compensation in Illinois operates through a no-fault insurance plan. Benefits through the system are guaranteed to all covered workers, regardless of who is at fault.
- Third-Party Liability Claims: An injured worker may also be able to receive benefits through a third-party liability claim if an entity separate from their employer contributed to a crash. This could include the company that owned or operated a truck that crashed into a construction site.
It can be difficult to know where to begin after being injured at your job. Many victims will need to take extensive periods of time away from work and may also be left with high medical bills. This is where an experienced personal injury attorney can really help. They can ensure that you receive all of the medical and financial support that you are entitled to under the law.
