Liability for Quincy Pedestrian Accidents
All drivers in Illinois must use caution to avoid colliding with any pedestrian in the roadway. According to Illinois Vehicle Code 625 ILCS 5/11-1002, “When traffic control signals are not in place or not in operation the driver of a vehicle shall stop and yield the right-of-way to a pedestrian crossing the roadway within a crosswalk when the pedestrian is upon the half of the roadway upon which the vehicle is traveling, or when the pedestrian is approaching so closely from the opposite half of the roadway as to be in danger.” Drivers take several actions to avoid colliding with pedestrians.
- Drivers should check their blind spots before making any turn at an intersection.
- Drivers should continuously scan the road ahead of them and slow down for potential hazards.
- Drivers should abstain from alcohol and other intoxicating substances.
If a driver fails to slow down to avoid colliding with a pedestrian in the roadway, this may be construed as negligence. Depending on the facts of any case, there could be numerous liable parties for any pedestrian accident. This could include any business that owned or operated a pickup truck. Pick up trucks and vans are routinely used for commercial purposes. The purpose of any driver’s trip prior to an accident should be well understood.
