Liability For Champaign Semi-Truck Accidents

Thousands of people are killed or seriously injured every year in semi-truck accidents. According to the National Safety Council, “Also in 2020, 107,000 large trucks were involved in crashes resulting in an injury, a 10% decrease from 2019. Since 2016, the number of trucks involved in fatal crashes has increased 5% and the involvement rate per 100 million large truck miles driven has remained steady at 35.” There are a number of steps that truck drivers should take to prevent collisions.

  • Truck drivers should ensure that their vehicles are properly maintained.
  • Truck drivers should always obey all speed and traffic regulations.
  • Truck drivers should abstain from alcohol and other intoxicating substances.

Truck drivers must acquire a commercial driver’s license and follow all rules set forth in Title 49 of the Code of Federal Regulations. If a truck driver is involved in a crash or is otherwise obstructing a roadway, there are a number of steps that they are legally obligated to take. The truck driver should activate their hazards and may need to put out flares or reflective triangles to warn other drivers about their presence. Warning devices must be placed within ten minutes of an accident under certain conditions. Failing to take these steps could form the basis of a negligence claim. There are many steps that should be taken after a truck accident.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • A thorough, independent investigation should be conducted.

Losing someone in a car accident can be one of the most difficult things that most people will ever go through. It is important to remember that accident victims and their families do have rights. The family of any person that is killed in a car accident may have legal recourse through a wrongful death claim. Sadly, it is common for truck companies to fight hard to deny liability for any collision.
