Liability for Injuries Involving Consumer Products

Companies that create consumer products have a legal obligation to ensure that those products are reasonably safe. They must abide by all federal safety guidelines and test their products and all the ways that they’re likely to be used and misused. This obligation also applies to the company that manufactures a product. Many product defects are the result of manufacturing defects. Wine bottles that break apart can cause all sorts of trauma.

  • Lacerations: Victims may sustain deep lacerations that require immediate medical attention.
  • Puncture Wounds: shards of glass from a wine bottle could potentially cause major puncture wounds all over a person’s body.
  • Eye Injuries: The fragments of a fractured wine bottle could lodge themselves in a person’s eye and cause partial or total blindness.

Product liability claims may be based on negligence or breach of warranty. However, product liability is typically considered a strict liability offense. A defendant will typically be liable if a plaintiff proves that a product is defective, regardless of the intent of the defendant. It doesn’t matter if a manufacturer exercised a great deal of care to make their products safe.

Steps to Take After Being Injured by a Consumer Product

Many people are injured in accidents involving consumer products every year. According to the Consumer Product Safety Commission, “In 2020, an estimated 28,535,000 people sought medical attention for an injury related to, but not necessarily caused by, a consumer product. This is a decrease of more than 7.7 million (21 percent) from the 2019 estimate.” It is important that certain actions are taken after any accident with a consumer product.

  • Medical Evaluation: Victims should seek a medical evaluation as early as possible.
  • Report: The incident should be reported to the manufacturer.
  • Recall List: It should be determined if the affected product was on any recall list.
  • Legal Evaluation: Any incident where a person was injured by a defective product should be carefully evaluated by an experienced product liability attorney.

It can be difficult to know where to begin after any accident involving a wine bottle or other consumer product. People may sustain lacerations that leave them with high medical bills. It is important for accident victims to understand that they do have legal rights. They are able to seek some measure of accountability and justice through a personal injury claim. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering.
