Liability for Homewood Pedestrian Accidents
Many pedestrians are seriously injured or killed every year in car accidents across Illinois. According to the Illinois Department of Transportation, “Crashes involving pedestrians accounted for 1.4% of total crashes, 16.9% of fatal crashes and 6.2% of injury crashes. Crashes involving pedalcyclists accounted for less than 1.0% of total crashes, 3.1% of fatal crashes and 3.8% of injury crashes.” There are many factors that can contribute to pedestrian accidents.
- Speeding: Pedestrian accidents are much more likely to happen if drivers are speeding.
- Distracted Driving: Pedestrian accidents often involve a driver that is distracted by their cell phone or other objects.
- Inclement Weather: Drivers are much more likely to lose control of their vehicle and hit pedestrians if it is raining or there are other adverse weather conditions.
- Driver Intoxication: A large portion of pedestrian accidents involve a driver who was intoxicated. This may include instances where a driver is intoxicated by alcohol or medications.
Drivers have a legal obligation to take steps in order to avoid hitting pedestrians. This includes situations where a pedestrian is outside of a marked crosswalk. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-1003.1, every driver must exercise due care to avoid colliding with any pedestrian. They must also use their horns when necessary and exercise the proper precautions to avoid colliding with any child or obviously confused person.
Liability for any pedestrian accident could extend beyond an at-fault driver. Many of the vehicles that are on the roadway are used for commercial purposes. This is particularly true with respect to vans and pickup trucks. If the driver of a vehicle was working at the time of a collision, their employer may bear some liability for the crash. As a general principle, employers are usually responsible for the negligent actions of their employees who are working within the course and scope of their job duties. It is important that certain steps are taken after any pedestrian accident.
- Accident Construction: Investigators may need to perform accident reconstruction in order to determine what caused or contributed to an accident.
- Evidence Collection: all evidence related to the accidents should be preserved. This will usually include photos, surveillance footage, and witness testimony.
- Logbooks: It should be determined if the driver involved in the collision may have been working. Truck drivers should have their logbook examined.
Pedestrian accidents are often highly preventable. They tend to involve situations where drivers are either distracted or not paying sufficient attention to hazards in the roadway. Intersections can be particularly dangerous, especially as drivers are making left-hand turns. Left turns were involved in nearly 10 times more collisions as opposed to right-hand turns. The family of any person killed in a pedestrian collision may be able to seek some measure of accountability through a wrongful death claim.
