Man Killed In Stabbing At Des Plaines Burger King Along South Elmhurst Road

DES PLAINES, ILLINOIS (December 28, 2023) – A man has tragically died after being stabbed at a Des Plaines Burger King located on the 800 block of South Elmhurst Drive.

Cook County officials are saying that the incident took place around 6:00 p.m. on Wednesday. Two men were in some type of altercation when one of them was stabbed several times.

Paramedics were called to the Burger King in order to help the victim. He was taken to a local area hospital where he was pronounced dead. He was later identified as Mario Jara-Antemante.

Police are still searching for the suspect involved in the attack.

Liability For Des Plaines Restaurant Attacks

Attacks at restaurants are actually far more common than many people realize. In fact, the FBI has rated restaurants as the 8th most common setting for violent crimes.  According to Restaurant Business, “The findings show that about 2% of the 675,517 violent attacks logged in total during 2020 occurred inside eating and drinking places. Included in the industry-specific tally were 76 murders and 5,642 robberies.” There are a number of steps that restaurants should take to prevent violent crime.

• Restaurants should make sure that their premises are well lit.
• Restaurants can also implement surveillance systems.
• Employees should be trained on conflict resolution and de-escalation techniques.
• Restaurants may need to hire security at some locations.

Pursuant to Illinois Civil Code 740 ILCS 130/2, property owners have a duty to maintain their premises in a reasonably safe condition. All restaurants have a legal obligation to protect their guests from reasonably foreseeable sources of harm. This includes protecting against harm caused by attacks from third parties. If a restaurant fails to protect guests from violent attacks, this could form the basis of a civil claim. It is important that evidence is properly preserved after any violent attack.

• Eye witnesses should be interviewed.
• Medical records should be preserved
• Surveillance footage should be sought.
• A police report should be created.
