Liability For Dekalb County Semi-Truck Accidents
Accidents involving tires may seem like freak occurrences, but they are actually quite common. According to Automotive Fleet, “Some 11,000 accidents occur every year due to bad tires, according to the National Highway Traffic Safety Administration (NHTSA). Moreover, dangerous driving conditions from winter weather and driving on worn tires are two of the most common causes for vehicle collisions.” There are a number of reasons that a vehicle tire may come off an axel.
- The lug nuts or bolts holding the wheel to the axel may have been improperly tightened.
- The wheel may have been improperly installed.
- The wheel bearings may fail which could eventually lead to a detachment.
- Problems with a vehicle’s suspension can contribute to a wheel detachment.
Truck drivers are held to a high standard in terms of safety. They must do everything within their power to prevent accidents. This includes taking the necessary steps to prevent catastrophic failures with their truck. Semi-trucks are in constant use and therefore require a great deal of maintenance. If a truck driver failed to properly maintain their vehicle, this could form the basis of a negligence claim. It is important that evidence is properly preserved after any truck accident.
- Eye witnesses should be interviewed.
- The truck driver’s logbook should be reviewed.
- Maintenance records for the truck should be examined.
- A thorough investigation should be conducted.
Depending on the facts of any case, the company that manufactured a truck or its component parts could also be liable for a collision. Companies have a legal obligation to create products that are reasonably safe. A company could be liable for an accident if it was caused by a defective product. Any person that is injured in a truck accident may have legal recourse through a civil claim.
