Liability for Cook County Semi-Truck Accidents

Commercial trucks and other large vehicles have unique features that can make them dangerous. According to the Federal Motor Carrier Safety Administration, “Large trucks or buses (commercial motor vehicles, or CMVs) have operating limitations such as large blind spots, long stopping distances, and limited maneuverability that make it essential for other vehicles to put extra focus on safety.” There are many ways that the blind spots on trucks may contribute to accidents.

  • A vehicle may be within the blind spots on the side of a truck. In this situation, a truck driver could inadvertently hit the smaller vehicle while changing lanes.
  • A pedestrian or cyclist could cross in front of a truck’s blind spots. Many pedestrians have been hit while crossing the street as a truck driver continued to move forward after a light.
  • Truck drivers could easily hit a vehicle as they are making a right-hand or left-hand turn. Commercial trucks have large blind spots on the sides of the vehicle that can obscure smaller cars.

Truck drivers should be intimately familiar with how their vehicle operates. They should be trained to check their blind spots and check for oncoming traffic before making left turns. But in far too many situations this does not take place. Pursuant to Illinois Vehicle Code (625 ILCS 5/11-707), no person shall make a left turn or U-turn upon a roadway unless such a movement can be made with reasonable safety. When a truck driver fails to yield the right of way to oncoming vehicles before making a left-hand turn, they could be held at fault through a bodily injury claim. Victims of truck accidents tend to suffer very serious injuries.

  • Broken bones
  • Head injuries
  • Lacerations
  • Organ damage
  • Death

Left turns are among the most dangerous maneuvers that any driver can make. They can be particularly dangerous for large trucks, given their wide turning radius. According to one study by the NHTSA, left turns were identified as the critical pre-crash event in 22.2% of car accidents. This compares with just 1.2% for drivers making right-hand turns. Any person that is injured in a truck accident may seek some measure of accountability through a bodily injury claim. Damages in a civil claim can help cover many different items, such as medical bills and lost wages.
