Liability For Wonder Lake Tractor Accidents
Farm tractors present a number of safety issues for workers. According to the U.S. Bureau of Labor Statistics, “A total of 146 workers suffered fatal injuries in incidents involving tractors in 2018. This was the lowest number of work deaths involving tractors on record between 2011 and 2018. Among fatal incidents involving tractors, 103 of the 146 deaths in 2018 occurred to workers age 55 or older, and 67 deaths were to workers age 65 or older.” There are a number of common causes of tractor accidents.
- Tractors are top-heavy and therefore prone to tipping over. A rollover accident can be deadly if the tractor lacks rollover protection structures (ROPS).
- Tractor collisions may be caused by mechanical failures with the brakes or steering.
- Tractors are much more difficult to operate than passenger vehicles. Workers should be given specialized training to ensure that they can operate it safely.
Depending on the facts of any case, there could be numerous sources of liability for any accident involving a tractor. For example, the company that manufactured a tractor could be held liable. Consider, for example, Morrison v. Kubota Tractor Corp. A tractor company could be liable for failing to install rollover protection structures (ROPS) on their vehicle. When these structures are not present, the tractor can become unreasonably dangerous. Victims of tractor accidents tend to suffer very serious and costly injuries, including:
- Broken bones
- Spinal cord injuries
- Lacerations
- Head injuries
- Organ damage
It can be hard to know what to do after any tractor accident. Victims are often left with high medical bills. They may also need to take extensive periods of time off work. It is important that accident victims understand that they do have rights. Any person injured in such an accident may have legal recourse, even if no other person was directly involved in the accident. A personal injury attorney can examine the unique facts of your case and let you know what your legal options are.
