Liability for Illinois Pedestrian Accidents
All drivers in Illinois have a legal obligation to use caution to avoid colliding with any pedestrian in the roadway. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-1003.1, every driver must exercise due care to avoid colliding with any pedestrian. They must also use their horns when necessary and exercise the proper precautions to avoid colliding with any child or obviously confused person. Drivers should take several measures to avoid colliding with any pedestrian in the roadway.
- Drivers should check their blind spots before making turns at an intersection.
- Drivers should continuously scan the road ahead of them for pedestrians and other hazards.
- Drivers should use their turn signals to alert pedestrians of their intentions.
If a driver fails to slow down to avoid colliding with any pedestrian, this could serve as evidence of negligence. Even if a pedestrian is in the middle of the road, this does not relieve them of their responsibility to use caution. When a driver leaves the scene of any injury collision, they could also face criminal liability for a crash. Drivers must remain at the scene of any collision that results in injuries to other people.
Steps to Take After Illinois Hit-And-Run Car Accidents
Hit-and-run collisions remain a major cause of preventable injury and death. According to the AAA Foundation for Traffic Safety, “research finds that 15% of all police-reported crashes in 2023 involved a driver who fled the scene, the highest percentage recorded in any recent year. The research reveals a growing crisis on Americaās roads, one that leaves injured people alone, without help, and too often without accountability.” Several actions should be taken after any hit-and-run car accident.
- Surveillance footage that may have captured the collision should be sought.
- Medical records related to the accident should be preserved.
- Fragments of the fleeing vehicle should be sought.
- The family of any person who died should seek the guidance of an experienced attorney.
Pedestrian accidents tend to be highly preventable. They often involve drivers who are intoxicated or not paying adequate attention to the road ahead of them. Any person injured in a car accident due to the negligent actions of a driver may be able to pursue some measure of justice and accountability through a civil claim. This right also extends to the family members of any person who dies in a collision.
