Martin Jimenez Killed In Elgin Train Accident at State Street Crossing

ELGIN, ILLINOIS (November 23, 2025) – A landscaping truck driver identified as Martin Jimenez has tragically died in an Elgin Union Pacific Railroad train accident at the State Street crossing.

Kane County officials are saying that the accident took place around 6:30 AM on October 23. Martin Jimenez was operating a Ford F250 truck that was pulling a trailer owned by Cornerstone Partners.

The landscaping truck was hit by a Union Pacific Railroad train. Firefighters and paramedics were called to the scene of the collision to help all of the victims.

Tragically, Martin Jimenez died due to the severe nature of his injuries. Two other people were injured in the crash and transported to the hospital.

The National Transportation Safety Board (NTSB) has conducted a preliminary investigation into the circumstances surrounding the crash. They revealed that the driver had almost no advanced notice of the oncoming train that killed him.

The train’s whistle and crossing signals only operated as the truck entered the crossing. One person who lives nearby said that this is the third accident at this particular crossing that he can remember.

A full investigation into the Elgin train accident remains ongoing at this time.

Liability for Elgin Train Accidents

Railroad operators have a legal obligation to maintain their premises in a reasonably safe condition and can be liable for accidents cause by dangerous conditions. The Supreme Court of Illinois has affirmed this time and again. Consider, for example, GEORGE WARD, Appellant, v. K MART CORPORATION, Appellee, “A possessor of land is subject to liability for physical harm caused to his invitees by a condition on the land if, but only if, he (a) knows or by the exercise of reasonable care would discover the condition, and should realize that it involves an unreasonable risk of harm to such invitees, and (b) should expect that they will not discover or realize the danger, or will fail to protect themselves against it, and (c) fails to exercise reasonable care to protect them against the danger.” There are many ways that a railroad crossing may have been in a dangerous condition.

  • Warning System Failures: Railroad crossings should have active warning systems to let users know of impending danger. This should include flashing lights, bells, and gates. If any of these systems malfunction, this could create a dangerous condition.
  • Skewed Crossing Angle: a roadway may intersect a railroad crossing at an obscure angle. This could reduce sight distance for drivers and make it difficult to see oncoming trains.
  • Vegetation and Sight Obstructions: A railroad crossing may have its line of sight obscured by vegetation or buildings. This can make it incredibly difficult for drivers to adequately see oncoming trains.
  • Track Defects: A set of train tracks may have defects that allowed a vehicle’s tires to become wedged underneath. This could lead vehicles to become stuck on train tracks as trains approach.

Many lawsuits have been filed against railroad companies due to accidents caused by defects with their tracks. Railroads have a legal obligation to provide adequate warnings to anyone driving across train tracks.  Consider Danner v. Norfolk & Western Ry. Co., a case before the United States Appellate Court of Illinois. The court held, “Under the common law, a railroad has a duty to provide adequate warning devices at its crossings.” When evidence shows that a railroad crossing has extra-hazardous conditions, a railroad may need to provide additional warning systems.

Steps to Take After Kane County Train Accidents

Trains can be deceptively dangerous and are involved in many serious collisions every year. According to the National Safety Council, “Railroad deaths totaled 954 in 2024, a 1% decrease from the 2023 revised total of 967. Nonfatal injuries totaled 6,542, a 3% decrease from the 2023 revised total of 6,768. From 2023 to 2024, fatalities at highway-rail crossings increased 7%, while fatalities involving other types of incidents decreased 4%.” It is important that certain actions are taken after any train accident.

  • Investigation: the police should be called to the scene so that they can begin an initial investigation. Though, police authorities are not the main entities that will investigate train accidents. This will typically be taken over by the National Transportation Safety Board.
  • Evidence Preservation: As much evidence as possible should be preserved after any train accident. Lots of photos of the accident site should be taken. Surveillance footage of the crash should also be sought.
  • Medical Records: All of the medical records related to the crash should be gathered. These can help establish the severity of any person’s injuries and provide crucial details on how an accident unfolded.
  • Legal Review: Any person affected by a train accident should seek the legal guidance of a team with experience in tort claims. They can investigate all of the unique facts of any train accident and help identify all of the potentially liable parties.

Train accidents are often highly preventable. In many cases, they involve train tracks with defective warning systems or obstructed lines of sight. If there is a history of collisions at a particular intersection, this is a red flag that there could be a problem. A history of accidents also may serve as constructive notice of a dangerous condition, thereby creating liability for the owner of the tracks in the event of an additional accident. Victims of train accidents are able to seek some measure of justice and accountability through a civil action. This right extends to the surviving family members of any person who died due to a dangerous condition with railroad tracks.
