Liability for Godfrey Car Accidents

Drivers have a legal obligation to exercise due care to avoid hitting pedestrians. According to Illinois Vehicle Code 625 ILCS 5/11-601, “No vehicle may be driven upon any highway of this State at a speed which is greater than is reasonable and proper with regard to traffic conditions and the use of the highway, or endangers the safety of any person or property.” Drivers should take many actions to avoid any pedestrians.

  • Blind Spots: Drivers should check their blind spots before making turns at intersections and changing lanes.
  • Fatigue: Drivers should be well rested before heading out onto the road.
  • Scanning: Drivers should continuously scan the road ahead of them for potential hazards.

If a driver fails to slow down to avoid hitting a pedestrian in the roadway, this could form the basis of a negligence claim. Depending on the facts of any case, liability for a pedestrian accident could extend beyond any driver deemed to be at fault. This is particularly true if a truck or other vehicle was being used for commercial purposes at the time of a collision. Employers can be held vicariously liable for the wrongful actions of their employees who are operating within the course and scope of their job duties.

Steps to Take After Godfrey Pedestrian Accidents

Thousands of people are seriously injured or killed every year in pedestrian accidents. According to the IIHS, “Deaths from motor vehicle crashes with pedestrians have increased 78% since reaching their low point in 2009 and account for 18% of crash fatalities. The rates of pedestrian crash deaths per 100,000 people are highest for people ages 20 and over.” Multiple actions should be taken after any pedestrian accident.

  • All medical records related to the accident should be collected and preserved.
  • Surveillance footage that may have captured the crash should be sought.
  • Eyewitnesses should also be interviewed. They can provide a great deal of information about what led up to a collision.
  • The family of any person who died in a pedestrian collision should carefully consider all of their legal options.

Pedestrian accidents are often highly preventable. They tend to be the results of clear safety lapses. This could include instances where drivers are not scanning the road ahead of them or traveling at a safe speed. Unfortunately, drivers and their insurance providers will often do everything in their power to deny liability if a pedestrian is killed in a collision. This is why it’s so important for these accidents to be carefully reviewed by experienced legal counsel.
